There are fifteen states and District of Columbia joined the Department of Justice in suing Apple involving the Sherman Act.

  • New Jersery
  • Arizona
  • California
  • Connecticut
  • Maine
  • Michigan
  • Minnesota
  • New Hampshire
  • New York
  • North Dakota
  • Oklahoma
  • Oregon
  • Tennessee
  • Vermont
  • Wisconsin

The real questions being asked today is will the DOJ win? How long will it take for a decision? What will happen if the president changes?

Will the DOJ Win?

The DOJ started investigating in 2019, and waited until now to file against Apple. Most would think that the DOJ belives they have a strong enough case to change Apple’s practices.

How long will it take for a decision?

The decision duration is unknown, when Microsoft was sued in the 1998. After a court decisions and appeals, Microsoft and the DOJ setted in September of 2001. Each case may be different but that is an example of the time line.

What will happen if the president changes?

Most likely nothing, it is unlikely that a change in president will change how the government looks at this lawsuit. The investigation started under a Donald Trump adminstration and the Joe Biden administration has continued to express not wanting to allow monopolistic practices.
